Rules

The Funeral Rule as set forth by the Federal Trade Commission (FTC) ensures that consumers have the right to provide a casket by their own means, without penalty. This means that:

  • Buying a casket or coffin for sale online and arranging delivery to your selected Funeral Home for use in a Funeral Service is legal in all 50 States
  • Funeral providers cannot refuse to use a casket or coffin you bought online, or put unreasonable or onerous restrictions on when it must be delivered or who must receive delivery
  • You cannot be charged an additional fee if you supply the casket - federal law prohibits funeral directors from charging “casket-handling” or other fees for people who purchase their casket online
  • You cannot be required to purchase any goods or services that are not required by law - funeral homes are allowed to charge one non-declinable “basic” fee, but only one, and this should be for basic or required goods and services
  • The funeral home may not lie about or misrepresent funeral or cemetery laws, rules, or regulations - if you are told something is required by law, ask for a copy of the law
  • Other kinds of misrepresentations, such as to the quality of caskets or coffins bought online, or the likelihood of damages in transit, are also illegal. Consumer protection laws in most states also prohibit such deceptive practices. State Licensing Boards in all 50 states have the right to (and do) discipline Funeral Directors for dishonesty and misrepresentation, and Federal law also prohibits dishonest, deceptive, and unfair acts and practices

"Gravesite Only With No Attention to Detail"

I was so disappointed in the way Case Funeral Home handled my mother’s gravesite only service. They basically picked my mother up from home, put her in their cooler and then put her body in the lovely (closed) coffin I ordered from Titan. I am sure the funeral homes are not excited about the loss of revenue from a scaled down funeral plus not making money on a coffin. I get it. My husband and I were luckily the first to arrive at the gravesite. We had been told by our coordinator from Case (Megan) that she would be in constant communication with Roselawn so when we saw the hearse backed up to the the grave, we quickly told them that we had discussed with Roselawn that we would be using the “chapel” . Case then drove the hearse to the chapel and unloaded the casket. When we first saw the coffin, both my husband and I were appalled to see the lid on crooked. My husband mentioned it to Gabby. We were told that the coffin was defective and the seal was “sprung”. My husband looked at the lid closely and told Gabby that the funeral home had not tightened something down and it was keeping the lid from closing properly. The funeral home staff did correct it but why should people in mourning be rushing to figure this out when people are arriving for the service? We were not offered a chance to purchase a guest book or any memory cards which would have helped me remember who showed up as I did want to send thank you cards. Memory cards should have been given out even thought we probably only had 50 or 60 people there. The option should at least have been offered us. I ended up spending a lot to have a beautiful memory card/thank you note done professionally. We choose a gravesite ceremony not because we are cheap but because my mother was 87 and we wanted simple and elegant and my brother nor I wanted nothing to do with a grueling day of people telling us how sorry they were that our sick and feeble mother had died. It was just too much! We also had decided at Case that we would view the lowering of the coffin into the grave which never happened. Communication between the cemetery and Case must not have happened. My father passed about 2.5 years ago and the funeral home from Frankenmuth did a superior job however we did have a viewing but we ordered the casket online. The gravesite only service ended up being extremely stressful and not the send off that I was hoping for.
